An Ann Arbor classic, The Brown Jug, applied to register the TM "BUCKEYE TEARS" for beer and liquor. OSU is trying to stop it. The forum is the USPTO’s TTAB, where brands argue about who can claim what. What OSU wants to avoid is buyer confusion and a tie between the school and alcohol. What the bar is leaning into is a joke every Big Ten fan understands. Same words, completely different stories. What will likely decide this: 1. Packaging and context. Colors, fonts, slogans, and any hint of school indicia. That is what a real consumer sees. 2. Where it sells. A Michigan bar pouring a Michigan rivalry joke is not the same as national cans dressed like game day. 3. Brand stretch. Famous university marks travel far, but not everywhere. The key question is whether an ordinary buyer would think OSU approved the product. Parody helps only if people get the joke and still do not think the school is behind it. Takeaways for brands and bars: 1. Rivalry language can be brilliant marketing, or a legal headache. Execution is everything. 2. Intent to use filings are fine, your real world rollout will be Exhibit A. 3. Policing is part of brand stewardship, resolution can be guardrails, not a full stop. No matter how the TTAB rules, both sides already scored free press.
