Did you know that your will might NOT control who receives your retirement accounts when you die? As a Florida estate planning attorney, I see this costly misconception which can lead to probate and family fights. Account Ownership determines who controls the assets while you're alive. Joint ownership means both parties have equal access and the surviving owner automatically inherits the account outside of probate upon death. Adding co-owners instead of beneficiaries can create serious problems such as: 🔒❌ Loss of control over your account 🎁🏥❓ Potential Medicaid eligibility issues Now, maybe you really did want co-owners BUT⚠️ because if both owners die and there is no beneficiary designation on an account, your heirs will likely need to hire an attorney to navigate the expensive and time-consuming probate process. Beneficiary Designations determine who receives account assets after your death, bypassing probate regardless of what your will says. Many people mistakenly believe their will overrides beneficiary designations.
