Can global mass torts ever deliver consistent justice across jurisdictions? This question was at the heart of the Panel on Global Mass Torts Litigation at the Perfect Law Global Class Actions & Mass Torts Conference in Florence. Panelists: • Scott Hardy - President, Top Class Actions & Trimaxian (USA) · Chair • Andy Rogers - Chief Revenue Officer, Shield Legal (USA) • Damiën Berkhout - Founding Partner, Lindenbaum (Netherlands) • Clare Ducksbury - Senior Vice President, Epiq Class Action Solutions Europe (UK) • Greg Haber -VP, International Class Actions, Verita Global (USA) 🔑 Insights from the discussion - Cross-jurisdictional disparities: The same wrongdoing produces very different outcomes depending on where claims are filed. The UK’s Volkswagen settlement in 2022 (£193m for 90,000 claimants) was a milestone, but similar emissions cases elsewhere remain unresolved. - Global settlements remain elusive: Dutch courts (via WCAM/VAMCA) have enabled cross-border resolutions such as Converium, Shell, and Fortis. Yet the EU’s Representative Actions Directive leaves uncertainty - some cases (like competition law) may still allow broader “global peace,” while others are now harder to resolve cross-border. - Opt-in vs. opt-out models: Different case types align with different approaches. Competition law matters often lean opt-in, while ESG and product liability cases increasingly test opt-out. Opt-in systems can deliver stronger, evidence-based claims; opt-out systems simplify participation but raise fairness and notice challenges. - Creative legal strategies: Case studies like the PIP breast implant litigation showed how practitioners adapted when manufacturers collapsed - targeting clinics, banks, or even oversight bodies to secure outcomes. - Funding and access to justice: Institutional litigation funding is essential but ties up capital for years, slowing the pipeline of new claims. Balancing financial viability with claimant-focused justice is critical. - The role of settlements: Court-approved frameworks remain key, but effective out-of-court settlements (such as the Dutch diesel case) can also deliver high claimant participation and practical resolutions. - The call for coordination: Panelists urged more synchronized filings and settlements to avoid fragmented, sequential claims across multiple jurisdictions - improving efficiency and outcomes worldwide. 💬 Andy Rogers, Chief Revenue Officer at Shield Legal, summed it up: “Huge compliments to everyone who came today – it’s inspiring to be in an environment where we all share the same goal: to bring justice.”

🚨 Partner hires in London’s litigation market have already surpassed last year’s total, fuelled by growth in IP, arbitration and product liability work, according to a new report. The research from recruiter Macrae says the 35 lateral moves recorded so far in 2025 already beats last year’s total of 34, with IP (including tech) accounting for almost a quarter of moves.
