This Privacy Policy (the “Policy”) describes how Dick Clark Productions, LLC (“DCP”, “we,” “us,” or “our”) collects, uses, and discloses personal information about you, online, including through our website, other online services where we post this Privacy Policy, and through our events (collectively, the “Services”).

This Privacy Policy does not apply to personal information we collect from our applicants, employees, or contractors. By accessing or using the Services or otherwise providing us with information, you acknowledge the applicability of this Policy.  If you do not agree to this Policy, please do not access or use the Services or provide us with information.

  1. We collect information from and about you.

We collect, receive, and develop several different types of personal information about you depending on the nature of your interactions with us. We collect information when you provide it directly to us, automatically through your use of the Services, and from other parties. We need certain types of information to provide the Services. If you do not provide us with such information or if you ask us to delete that information, you may no longer be able to access or use certain aspects of the Services.

A. Information You Provide to us Directly:

We collect information that you provide to us directly, such as when:

  • You access or use the Services;
  • You request information from or about us or the Services;
  • You fill out an online form;
  • You subscribe to emails or other forms of communication;
  • You register or attend events; or
  • You otherwise communicate or interact with us.

The information you provide to us directly may concern you and others and may include, but is not limited to:

  • Contact Information and Identifiers. For example, we may collect your name, email address, phone number, business name, and mailing address.
  • Demographic Information. We may collect demographic information, such as your age, date of birth or gender.
  • Location Information. We may collect information about your location using your IP address and your zip code.
  • Information You Submit. We collect any information or feedback you provide when you contact us, such as when you submit questions, submit an award nomination, submit a Golden Globes voter application, communicate with our customer support, or otherwise communicate with us.
  • Audio or Visual Information: If you contact customer support, we may record calls we have with you and if you attend an event or visit one of our properties, we may CTV or security footage at such events and properties.
  • Preference Information. We may collect information about your preferences when using our services or platforms. We may also collection information about your preferences that you share.

B. Information We Collect Automatically

We and our vendors collect information about you automatically, based on your online activity. This information includes:

  • Internet and Online Activity Information. We collect information about the browser you are using and your IP address. We also collect device identifiers. We may use tracking tools like cookies to automatically collect information about how you interact with our Services, such as how you interact with emails we send, your browsing on our website, what areas of our website you visit and for how long, what content you click on, what site you came from, and what site you visit when you leave us.
  • Inferences. Using information you provide directly to us and other information we collect, we may draw inferences about your preferences, characteristics, and experiences.

C. Information We Collect From Other Parties

We collect information about you or others through our affiliates or through non-affiliated parties.

  • Vendors. We receive information from vendors we hire to work on our behalf, such as vendors that host or maintain our website, analyze our services, and help us operate them.
  • Third-Party Partners and Other Third-Party Sources. We get information from other parties. We may receive information from business partners, such as record labels, when you sign up for one of our events. We work with other business and marketing partners that might also include public and commercial data sources, affiliates, social networks and advertising and analytics providers that share information with us. We may also receive information from our affiliates and subsidiaries. The information we receive from certain partners may include publicly-available information, such as publicly-available information in social media profiles.
  • Other Users and Customers. We may receive information about you from other users or customers, particularly if you or others are using us in a business capacity. For example, users may provide us with information about colleagues or other prospective users of our Services.

We combine information. For example, we may combine information that we have collected offline with information we collect online. Or we may combine information we get from another party with information we already have.

We use the information collected about you through the Services for business purposes, including:

  • To provide and improve the Services.
  • To respond to your requests or questions. For example, we may contact you about the feedback you have given us.
  • To customize your experience with the Services.
  • To administer and secure our Services and for internal operations. This might include troubleshooting, data analysis, or testing.
  • For research, statistical, and survey purposes.
  • To protect the safety, rights, and/or integrity of the Services or other third parties, including our users, employees, business partners, customers, or other individuals.
  • For marketing and advertising purposes. We use your information to tailor and send you information about our Services, other services that might interest you or to tailor ads for you. Our marketing or ads might be for our own Services or for other companies’ offers, products, or services that we think you might find interesting.   • To communicate with you about our Services, including providing you information about our policies or our terms.
  • To comply with our legal obligations.

We use information as otherwise required, disclosed, or permitted by law or as we may notify you from time to time.

We may aggregate and/or de-identify information collected through the Services. We may use de-identified or aggregated data for any purpose, including without limitation for research and marketing purposes and may also disclose such data to any third parties.

  1. We DISCLOSE information TO other parties.

We may disclose information about you in the following situations:

  • Affiliates. We disclose certain information within our family of companies in accordance with applicable law. This includes our subsidiaries, parents, and affiliates.
  • Vendors. We disclose information to vendors who perform services on our behalf for our business and operational purposes. For example, we may make information available to vendors who send emails for us, manage and operate our website, assist us in our marketing and advertising, including partners that contribute to our promotional efforts, track advertising impressions, provide analytics services, investigate and prevent data incidents, audit our records, vet job applicants, and provide legal advice. We may also disclose information to analytics and search engine providers.
  • Marketing Purposes. We disclose information to our business partners and marketing companies. We may disclose information to other parties, including for the other parties’ own marketing purposes. We may also share with social media platforms, advertising networks, and ad tech companies. Personal information received by our partners and other parties may also be subject to their privacy policies.
  • Legal and Security Purposes. We will disclose information for safety and security purposes, as we deem reasonably necessary to comply with the law, or to protect ourselves, our customers and others. For example, we disclose information to respond to a court order or subpoena. We disclose information if a government agency or investigatory body requests it. We also disclose your information in order to enforce our agreements, such as our Terms of Use, and to protect the rights and safety of others. We might also disclose information to others when we are investigating potential fraud.
  • Business Transfers. We may disclose information with a successor to all or part of our business or in contemplation of such a transaction. For example, if part of our business is sold, we may include information as part of that transaction. We may also share your information if there is a change to our corporate structure. We may also share your information with others as they conduct diligence of our corporate changes.
  • Consent/At Your Direction. We disclose information with nonaffiliated third parties based on your consent to do so.

You have certain rights and choices with respect to your information, such as the following.

Marketing Communications

Email: You can opt out of receiving our promotional emails by following the instructions in any promotional email you receive from us. Please note that if you unsubscribe from promotional emails, we will still send you administrative and transactional emails regarding the Services, including, for example, notice of updates to our Terms of Use or this Policy.

SMS Text Communications: You may opt-out of SMS messages from us (which we send pursuant to applicable law) by following the instructions provided in the message or by texting back STOP to the number we send the text from for that particular SMS message. When we receive an opt-out message from you for SMS messages, we may send a message confirming our receipt of your opt-out.

  1. You can control cookies and certain tracking tools.

We collect information about users over time and across different websites and devices. To do this, we and our vendors use several tracking tools, such as browser cookies, web beacons, and other technologies. You may have the ability to accept or decline (or opt out of) certain cookies for analytics and targeted advertising on our Services depending on your jurisdiction. Some analytics providers we partner with may provide specific opt-out mechanisms. For example, to prevent Google Analytics from using your information for analytics, please see the Google Analytics Opt-out Browser Add-on. You may choose whether to receive some forms of targeted advertising from many ad networks, audience segment providers, ad serving vendors, and other service providers by visiting websites operated by the Network Advertising Initiative and Digital Advertising Alliance or if you are a user in the European Economic Area, Your Online Choices. Many mobile devices allow you to opt-out of targeted advertising for mobile apps using the settings within the mobile app or your mobile device. Please note that if you exercise the opt out choices above, you will still see advertising when you use the Services, but it will not be tailored to you based on your online behavior over time.

  1. Your Privacy Rights

Laws in certain jurisdictions grant consumers the right to exercise certain controls and choices regarding our collection, use, and disclosure of your information.

If you are a California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah, or Virginia (“Covered State”) resident, or a resident of the EEA, UK, Canada, or Switzerland, you may request:

  • Access to and/or a copy of certain personal information we hold about you or to have certain information you gave us transferred to another entity.
  • Correction of inaccurate personal information we hold about you.
  • Deletion of certain personal information we have about you.
  • Information about the financial incentives that we offer to you, if any.
  • Restriction of or objection to certain processing of your information.
  • Withdrawal of your consent to our use of your information for certain processing purposes, where the processing purpose was based on your consent.
  • To opt out of the processing of your personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects, if applicable.

Residents of Covered States also have sale/targeted advertising opt out rights described below.

Applicable law may further provide you with the right to not be discriminated against for exercising your rights. If you have any concerns or complaints about our data processing activities, we urge you to first try to resolve such issues directly with us. However, if applicable, you may make a complaint to the data protection supervisory authority in your country about our processing of your personal data.

California residents can also:

  • Request information about the categories of personal information we collect, disclose or sell or share about you; the categories of sources of such information; the business or commercial purpose for collecting or selling or sharing your personal information; and the categories of third parties to whom we disclose personal information. Such information is also set forth in this Privacy Policy.
  • Limit processing of sensitive personal information as described in the California Privacy Notice below by clicking on the Your Privacy Choices link in the site footer and following the directions.

Residents of certain other countries may be able request one or more of the above under applicable law. Your rights and our responses will vary based on your state or country of residency. You may be located in a jurisdiction where we are not obligated, or are unable, to fulfill a request.  In such a case, your request may not be fulfilled.

For example, we need certain information for legal compliance or in order to provide the Services to you. In addition, where you may have these rights, the exercise of them is not absolute. Your rights may, for example, be outweighed by our rights and/or the rights of freedom of expression and information, including for the purposes of Editorial Activities.

Verification: We will take reasonable steps to verify your identity before responding to a request, which may include, depending on your request and relationship with you verifying your name, email address, address, and/or having you respond to an email from us.

Residents of certain states are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, we may require proof of your written authorization before processing the request. We may also follow up with you to verify your identity before processing the authorized agent’s request.

We will not discriminate against you because you made a request. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations.

Residents of Connecticut, Colorado, Montana, Oregon, Texas, Virginia may appeal the denial of a previously submitted request by emailing us at privacy@dickclark.com.

Please note: Your rights and our responses will vary based on your state or country of residency. You may be located in a jurisdiction where we are not obligated, or are unable, to fulfill a request. In such case, your request may not be fulfilled.

Sale/Targeted Advertising Opt Out Rights for Covered State Residents

Covered State residents may opt out of the “sale” of their personal information (as personal information/personal data defined by those states’ laws) or processing or sharing of such information for online targeted advertising purposes. We sell or share certain of your information to third parties that may directly provide you with offers and promotions and opportunities that may be of interest to you.

We also allow third parties to receive certain information, such device information and identifiers, such as IP address, and unique advertising identifiers and cookies; hashed identifiers, such as contact information; usage information, such as browsing history or app usage; location information, such as city; and inference data to deliver targeted advertising to you on the Services or other services. This activity may also be considered a sale under applicable law. Advertising, including targeted advertising, enables us to provide you certain content for free and allows us to provide you offers relevant to you.

To opt out for cookie, device and browsing data, click on Your Privacy Choices in the footer of your browser for each brand, site, or service and on each browser or device where you want your choices to apply.  To opt out for non-cookie data such as your contact information and associated information, complete the following form.

Please note that we do not knowingly sell the personal information of minors under 16 years of age without legally-required affirmative authorization.

Even if you opt out, you will still see advertising, it just may be less relevant to you, or it may be personalized for you based only data we have about you. preference may be lost if you clear, or your browser is set to clear, cookies. If you have enabled a legally recognized browser-based opt out preference signal (such as Global Privacy Control) on your browser, we recognize such preference in accordance and to the extent required by applicable law. You will need to turn this on for each browser you use. 

  1. Legal Grounds for Using (Processing) Your Information

Under the law of certain jurisdictions, such as the European Union, the UK, and Brazil, our legal basis for collecting and using the information described above will depend on the information concerned and the context in which we collect it. We collect information from you:

  • Where we need it to perform our contract with you (i.e. our Terms of Service) in order to provide the Services you request;
  • Where the processing is in our legitimate interests (provided that these aren’t overridden by your interests or rights) to secure our Services, prevent misuse, and fraud, and resolve technical issues; respond to your requests for information and provide you with more effective and efficient customer service; contact you regarding the Services, as well as surveys, promotions, special events, and other subjects that we think may be of interest to you (in accordance with applicable legal requirements); better understand your interests and improve our Services; personalize the Services; conduct internal business operations in support of our Services, such as auditing, sales and marketing, analytics, and research and development; and establish, exercise, or defend our legal rights;
  • Where we have obtained your consent to send you marketing and other commercial communications and use non-strictly necessary cookies where local law requires such consent for such marketing and cookies (please note these requirements vary by jurisdiction and not all jurisdictions require consent for such uses) or use your information as set forth in a release or in connection with a consent;
  • To comply with our legal obligations; or
  • To protect the vital interests of a person, such as their life or physical or mental well being.

We may also collect and use personal information in connection with your consent in other circumstances, which will be presented to you at the time of collection. You can revoke your consent at any time, though you might not be able to use a service or feature that requires collection or use of that personal information.

If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to provide you with some additional information. Depending on how you use the Services:

    • Internet or Other Network or Device Activity (such as browsing history);

    • Audio or Visual Information (such as if you call customer service, attend an event with security cameras, participate in a phone survey or submit a photo);
    • Demographic Data (such as gender);
    • Other information that identifies or can be reasonably associated with you.

    • to contact you;

    • to better understand those who use our Services;

      • And with your consent or in connection with a corporate transaction.
    • Device information and identifiers and internet or other network or device activity with entities that provide content, advertising, and functionality.

Sale or sharing of personal information.

We may share the following categories of information with advertising networks and providers, advertisers, and social media networks, which may be considered a “sale” or share under California law and is the processing of personal information for targeted advertising:

  • Device information and identifiers, such as IP address, and unique advertising identifiers and cookies; hashed identifiers, such as contact information; usage information, such as browsing history or app usage; location information, such as city; and inference data.

California residents can opt out of such targeted advertising by visiting Your Privacy Choices in the footer. California residents can also turn on the Global Privacy Control (GPC) to opt out of the “sale” or “sharing” of your personal information that is browser based for each participating browser system that you use. Right to Limit. The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. Please note, to the extent that we process sensitive personal information as defined by the CCPA, we do not use or disclose it other than for disclosed and permitted business purposes for which there is not a right to limit under the CCPA.

Shine the Light. If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their own direct marketing purposes. To make a request, please send us an email, or write to us at the address listed below. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

Retention. We keep your information to fulfill the purposes described above, unless a longer retention is required or permitted by law. Our retention is based upon the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. The purposes for which we process information may dictate different retention periods for the same types of information. For example, if you opt out of email marketing, we maintain your email on our suppression list for an extended time to honor your opt out. We may delete or de-identify your information sooner if we receive a verifiable deletion request, subject to exemptions under applicable law.

  1. Our website is not intended for children.

We do not knowingly collect personal information from children under 18. If you are a parent or legal guardian and think your child has given us information, you can contact us at privacy@dickclark.com. You can also write to us at the address listed at the end of this Policy. Please mark your inquiries “Children’s Information Request.”

  1. We transfer and store information.

Our website may be operated in the United States and other countries located outside of the European Economic Area (“EEA”). Please be aware that information you provide to us may be transferred to or processed in the United States or other countries located outside of the EEA. We will ensure that transfers of personal data to a third country or an international organization are subject to appropriate safeguards. Please also be aware that by using our Services or giving us your information, you consent to such transfer.

  1. We EMPLOY DATA security measures.

We have in place physical, electronic, and managerial procedures to help protect the information we collect. However, the Internet is not 100% secure. We cannot promise that your use of our website or services will be completely safe. Any transmission of your data to our site is at your own risk. We encourage you to use caution when using the Internet. This includes not sharing your passwords.

  1. We may link to third party sites or services we don’t control.

Our Services embed content from, or link to, third-party websites and services that are outside of our control. If you click on a link to a third-party site, you will be taken to a website we do not control. This Policy does not apply to the privacy practices of that website, which may collect information from you. Read the privacy policy of other websites carefully. We are not responsible for these third-party websites or their policies.
